The New Jersey Schools Development Authority (the “NJSDA” or the “Authority”) seeks to engage three (3) firms (hereinafter the “Consultant” or “Consultants”) to provide claims assistance services. Each Consultant will be expected to assist the NJSDA’s Division of Chief Counsel and its Construction Claims Unit in reviewing and determining the validity and value of submitted or anticipated claims by construction contractors, design professionals, project management firms (“PMFs”), construction management firms (“CMs”) and other entities with whom the NJSDA has contracted, relating to and arising from change order or amendment requests, on an as-directed and as-needed basis. The Consultant may also be asked to provide assistance to the NJSDA’s Division of Chief Counsel and its Construction Claims Unit in analyzing, calculating, reviewing and supporting the validity and value of affirmative claims asserted by the NJSDA. The NJSDA anticipates utilizing the Consultant to assist in the assessment of complicated and large dollar value claims, including those that require the devotion of extensive time and/or special expertise to evaluate. Claims assistance services shall be assigned by Task Order. The Consultant will be required to submit a proposed budget for each Task Order assignment. The budget shall be subject to NJSDA’s approval and acceptance prior to commencement of services under the Task Order assignment.

The NJSDA shall not hold a traditional Pre-proposal conference for this procurement. All firms wishing to submit a proposal MUST sign in electronically by sending a mandatory e-mail Notice of Intent to Participate to James McElhenny at jmcelhenny@njsda.gov no later than 5:00 pm on Monday, December 12, 2011.

Firms may submit questions to the NJSDA by sending them by e-mail to James McElhenny at jmcelhenny@njsda.gov no later than 5:00 pm on Monday, December 12, 2011. The questions and answers shall be provided electronically to each firm that submitted a timely e-mail Notice of Intent to Participate.

Completed Proposals MUST be received NO LATER than 5:00 PM on Wednesday, January 4, 2012, and may be mailed or hand delivered as set forth in the RFP.

Proposing firms MUST submit a true copy of their valid Business Registration Certificate issued by the New Jersey Division of Revenue and complete a Moral Integrity Questionnaire.

Evaluation Criteria: Submissions that are not responsive will be rejected without evaluation. Responsive submissions will be ranked pursuant to the following evaluation criteria:

  1. Understanding of the Purposes of this Engagement
  2. Firm Experience - Case Studies
  3. Experience of Key Team Members
  4. Approach to Providing the Required Scope of Services
  5. Approach to Control of Schedule


In addition, to be selected, a firm must be approved for moral integrity, pursuant to a review by the New Jersey State Police, as set forth in the RFP.

Bidders must comply with the requirements of P.L. 2005, c. 51, and implementing rules.
